Confidentiality Agreement

 

Sides;
 “Cebir Giyim San. registered at Mahmutbey Merkez Mahallesi 2567. Sokak no:6 34218 Bağcılar/İstanbul. and Tic. Ltd. Şti (hereinafter referred to as "Maraton") and the www.maratonsportswear.com website and/or mobile application ("Site and/or Mobile Application") member ("Customer") on the other hand, this agreement has been concluded under the following conditions. Maraton respects the privacy of its customers and uses best efforts to ensure the protection of personal data and information by complying with all relevant legislation regarding the protection of personal data.


1. Contract

After completing the registration process on the site, the customer can use the site or application by entering his e-mail address and password, provided that he complies with the conditions specified in this agreement. can start using it.
If the contract is concluded on behalf of a legal entity, the person concluding the contract accepts that he/she is authorized to carry out such a transaction on behalf of the legal entity in question, otherwise (in case of an unauthorized transaction), he/she will be personally responsible for all the consequential transactions he/she will do from now on. , declares and undertakes. In this case, Maraton will not be liable.
The Customer agrees that he will be deemed to have accepted all the terms of the Agreement from the moment he starts using the Site and/or Mobile Application and that these terms will be binding on him.


 2. Customer's Rights and Obligations
The Site and/or Mobile Application is a site and/or mobile application open to public use. Services provided through the Site and/or Mobile Application are free of charge.
The Customer accepts, declares and undertakes that, when using the Site and/or Mobile Application, he/she will act in accordance with all the terms in the contract and the rules specified in the relevant parts of the Site and/or Mobile Application.
While benefiting from the services offered on the Site and/or Mobile Application, the Customer shall be bound to the services of Maraton in accordance with the Code of Obligations, Turkish Penal Code, Turkish Commercial Code, Law on Intellectual and Artistic Works, Law on the Protection of Trademark and Patent Rights, Decree Laws and other relevant legislation. agrees to comply with all announcements and notifications to be published regarding the same. Any legal, criminal or financial liability that may arise due to use contrary to these notices and the law belongs to the Customer. In case Maraton makes a payment to any person or institution due to reasons caused by the customer, the paid amount can be recoursed to the customer.
The Customer cannot take actions that prevent or make it difficult for other members and visitors to use the Site and/or Mobile Application; cannot load and lock servers or databases with automatic programs or attempt to mislead data; Otherwise, he accepts that his membership will be terminated by Maraton and he will undertake any legal and criminal liability that may arise from this situation. Marathon will not have any legal liability in such cases. All legal liability will belong to the customer.
The Customer accepts, declares and undertakes that the personal and other information he/she provides when registering or shopping on the Site and/or Mobile Application is correct and that if this information is not correct, Maraton will immediately compensate all damages it may incur for this reason. Therefore, if payment is made to 3 people, the customer will also cover Maraton's damages.
The visual and textual content presented on the Site and/or Mobile Application is for personal use. All rights to all texts, graphics, photographs, videos, animations and sounds contained in the Site and/or Mobile Application are reserved; Unless stated otherwise, it cannot be used for commercial or personal purposes without permission. It is prohibited to publish or link to any element on the Site and/or Mobile Application in any other media or website and/or mobile application without Marathon's permission and written approval. Maraton reserves the right to file a lawsuit against those who act contrary to the damages they may incur.
The Customer cannot use, resell, share, distribute, exhibit, copy, reproduce, process, create or prepare derivative works from Maraton's copyrighted works on the Site and/or Mobile Application in any way, without the written permission and approval of Maraton. Otherwise, the Customer declares, accepts and undertakes that he/she will be responsible for all damages that Maraton has suffered or may suffer.
If the customer wishes to unsubscribe from the e-mail list at any time, he/she can unsubscribe from the e-mail.


3. Marathon  Rights and Obligations
 
In the following cases, Maraton has the right to cancel the transactions in question, stop the Customer's use or unilaterally terminate this Agreement immediately, in addition to all its rights arising from the law. If such a situation arises, Marathon records will be considered definitive evidence.
In case information containing false, irregular, incomplete and misleading information, statements that do not comply with general moral rules and that do not comply with the laws of the Republic of Turkey is recorded on the Site and/or Mobile Application;
In case of partially or completely copying and using or attempting to use the works and data on the Site and/or Mobile Application;
In case of using software that will threaten the general security of the Site and/or Mobile Application, preventing the operation of the Site and/or Mobile Application and the software used, performing or attempting to carry out activities, and obtaining, deleting or changing information;
In case the usage rights of information such as username and password given to customers by Maraton due to membership in the site and/or mobile application or determined by them are shared with third parties, the Member is directly responsible for the malicious use of the password by other persons. Likewise, the Member cannot use someone else's IP address, e-mail address, user name and other information on the internet, nor can he access or use the private information of other Members without permission. Any legal and criminal liability that may arise due to such use belongs to the member.  In these cases, Marathon records will be taken as basis and will serve as definitive evidence. Marathon will not have any legal or criminal liability.

The validity, interpretation and performance of this Agreement are subject to the laws of the Republic of Turkey. Bakırköy Courts and Enforcement Offices are authorized to resolve disputes that may arise from the implementation of this Agreement.
